CHP’s Deniz Yücel Criticizes Response to Constitutional Court’s Ruling on MP Can Atalay

Deniz Yücel, Deputy Chairman and Spokesperson of CHP, stated that the Constitutional Court’s reasoned decision regarding Hatay MP Can Atalay serves as a lesson in law and justice. Yücel emphasized that under Article 84 of the Constitution, it is not possible for a member of parliament to be dismissed without a finalized conviction.

In the Turkish Grand National Assembly (TBMM), Yücel described the reading of the Supreme Court of Appeals’ 3rd Criminal Chamber’s letter as “null and void.” Moreover, he considered a courtier’s remark that “Constitutional Court decisions lack executive impact” as a sign of contempt for the law and the court.

Recalling Article 153 of the Constitution, Yücel stated that the decisions of the Constitutional Court are binding on legislative, executive, and judicial bodies, as well as administrative authorities and natural and legal persons. He asserted that implementing the Constitutional Court’s decisions is an obligation in the Republic of Turkey. Yücel added that those exerting political pressure on public institutions to disregard the Constitutional Court’s rulings would soon be held accountable before the law.
